Residence permit for investment purposes

New legal provisions allow foreign investors to require a residence permit for investment purposes to those who visit Portugal regularly - holders of valid Schengen visas and beneficiaries of visas exemption - as long as they transfer capital, create jobs or invest in real estate to/in Portugal.

Holders of residence permits for investment purposes are entitled to bring their family with them, to be given a permanent residence permit, as well as to obtain Portuguese nationality, in accordance with current Portuguese legal dispositions.

Who may require a Residence Permit for Investment Purposes (Golden Visa)?

Citizens from foreign countries who commit to carry out investment activities - as individuals or through a company -, which may lead to the materialization of, at least, one of the following situations to occur in national territory for a minimum period of 5 years:

  • Acquisition of real estate worth 500,000 € or more
  • Direct Transfer of capital in the amount of, at least, 1 million€ (including the acquisition of shares in companies with activity authorized by the Portuguese Securities Market Commission)
  • The creation of a minimum of 10 jobs.

Yes, through the taxation system applicable to non-habitual residents.

Competitive advantages:
  • A flat rate of 20% on income earned in Portuguese territory will be applied for a period of 10 years.
  • No double taxation will be applied on pensions and on employed or self-employed income earned abroad.
How can I obtain the Non-Habitual Resident status?
  • By not having resided in Portugal in the last 5 years;
  • By registering as a tax resident in your local Tax Office. For such you must have lived in Portugal for more than 183 days, in a sequential or alternate way, or, having resided for less time, by holding, on 31st December of that year, a residence that will patently indicate your willingness to keep it and occupy it as your main residence;
  • By requesting the Non-Habitual Resident status at the time of your registration as a tax payer or, alternatively, until 31st March of the year following the one in which you started living in Portugal.
